On September 25th 2025, I asked Mistik if I was
allowed to use my UI code for another game I was working on (havre was
still pretty early in development and not announced). He told me I was
allowed to use it, but he would remove my developer roles and access
from diep, to which I agreed. He also tried to convince me that he was
going to use my UI in diep in the future if I didn't leave to make
my own game with it. I was (and still am) very skeptical about this.
(They changed the reasoning for why it was removed multiple times and
now say it will take long to implement, but it worked for multiple
weeks before)

On October 14th 2025, I was banned from diep.io's
official discord server, along with adam (he was admin in
tankeditor.io's discord server, the game i made before havre. We
talked about havre a lot in that discord before the game was
announced). When I asked about why I was banned, he said its because I
was "Trying to rip all of diep". He also threatened to sue me by saying
"see you in court" and asked for my lawyer's info.
I also removed all
instances of diep's name from diepeditor.io just in case, renaming
it to tankeditor.io.

On November 8th 2025, Havre.io publicly opened in beta
On November 18th 2025, a member of my discord made a
post on the r/diepio subreddit, telling people to come try havre.io.
Mistik then messaged the reddit moderators to tell them that the post
was "trying to promote an illegal clone of diep.io". The
post was then removed by moderators.

Message from mistik to the reddit mods
On November 21st 2025 at about 5 am, Aero (a previous diep dev) did
a ddos attack towards havre.io and has his dev roles removed from diep
in the same night. I originally accused mistik of being behind the
attack and having planned to remove aero's roles before the attack
so 3am wouldnt be held responsible. Mistik however claimed he had
nothing to do with it and instead demoted Aero after learning of the
attack. After consulting multiple sources to make sure this was true,
I deleted my original statement and made a new one to clarify that 3am
experiences didnt have anything to do with it and that they demoted
aero when they learnt about the attack.

On December 2nd 2025 at 10:59 am, I received a DMCA
notice for the havre.io domain from 3AM experiences sent to
cloudflare. This notice only had "https://diep.io" written in the field "Describe the copyrighted work in
full detail, including links to the original work or evidence of
source material", with no additional details regarding what
exactly they believe is infringing on their copyright. The notice also
said "3AM Enterprise LLC" instead of "3AM Experiences LLC"
First Notice
On that day, I made an announcement on my discord server, which I
forwarded to multiple servers and also posted on the r/diepio subreddit. Within
less than a day, Mistik messaged the reddit moderators to delete the
post by saying I keep "trying to promote [my] stolen
clone". He also emphasized that I used the UI he paid for (not
mentioning he explicitly told me I can use it for another project).
And saying i'm "using diep reddit to promote [my] rip
off". The post was deleted the next day at 11:15 am.

Message from mistik to the reddit mods
On December 4th 2025 at 12:23 pm, I replied to cloudflare with a DMCA counter-notice.
On December 4th 2025 at 13:05 pm (less than an hour
later), I recieved another almost identical DMCA notice. The only
differences are that the field where "https://diep.io" was written now contained "Original URL:
https://diep.io" and that the email
of the law firm in the footer was slightly different but from the same
firm.

On December 4th 2025 at 14:01 pm (less than an hour later), I sent the same counter-notice to the second notice

later), I sent an email to the legal firm, using the address in the
second notice, asking for precision on what content exactly they are
alleging to be infringing. I then sent a correction 5 minutes later,
because in my email I mentioned "3AM Experiences" when in
the notices it said "3AM Enterprise LLC"

On December 9th 2025 at 11:39 am, I tried again to
send an email to the legal firm, asking for precision. This time I
instead used the address of the lawyer (that had his name on the
notices) by finding it on the law firm's website.

On December 10th 2025 at 9:35 pm, I received a response to the second email I sent from another lawyer of the same firm. That email says it is confidential, so i dont know if I can legally share it. If i can i will add it here.
I am going to keep working on havre.io, adding new features and updates. On the legal side, I believe havre.io to not be infringing on copyright, so nothing new should happen unless 3AM decides to bring this to court. If they do, I believe they would face significant challenges, because:
